We” are: Durham City Cakes, Durham, Tyne & Wear (“The Baker”)

“You” are: The person (or persons) who have received the Quotation (where there is more than one person, they shall be jointly and severally liable).

(“The Client”)In this agreement: “The Assignment” Means the project of work, goods and services set out in the proposal.

WEDDING AND OCCASION CAKE TERMS AND CONDITIONS

Welcome to Durham City Cakes. By booking with us, you agree to the Terms & Conditions outlined below. These ensure a smooth, professional experience for both parties and protect the quality and integrity of our work.

The conditions set out here constitute our terms of sale. Please contact us for clarity on any matter which is not clear or you do not understand and note that nothing contained here affects your statutory rights as a consumer.

1. Orders
1.1 Orders may be placed via phone, email or our online booking form. A booking is not confirmed until the required deposit has been received.

1.2 Payments are accepted via bank transfer

2. Price & Payment

2.1 Prices are stated in your Quotation and include all design, baking, decorating, and administrative work. No VAT is charged.

2.2 A non-refundable Save the Date 'Booking Fee' is required:

  • Wedding cakes & cakes over £350: £100

  • Occasion cakes : £50 deposit

2.3 Payment of the 'Booking Fee' indicates acceptance of these Terms & Conditions.

2.4 The final balance invoice will be issued 4–5 weeks before the event. All fees must be paid no later than 4 weeks before the event date.

2.5 Quotations are valid for 30 days.

2.6. Minimum spends:

  • Wedding cakes: £350

  • Occasion cakes: £150

  • Distance weddings (3.5+ hours from DH50PW): £1100 + delivery

3. Cancellation & Postponement

3.1 Cancellation must be made in writing or via email.

3.2 If the Baker cancels, all fees paid will be refunded within 14 days.

3.3 If the Client cancels within 14 days of booking and the event is more than 45 days away, the deposit will be refunded unless bespoke design work has started.

3.4 Bookings made within 45 days of the event have no cooling-off period; the deposit is non-refundable.

3.5 Cancellation more than 14 days after booking and 31+ days before the event results in loss of the deposit.

3.6 Cancellation within 30 days of the event requires the full balance to be paid.

3.7 Postponements can be honoured once (subject to availability).

3.8 If the Baker is unavailable for the new date, the cancellation terms in Clause 3.5 apply.

3.9 Refunds may be issued by any method deemed appropriate by the Baker.

4. Design & Changes

4.1 All design rights remain the property of the Baker.

4.2 Minor design variations are at the Baker’s discretion and not eligible for refund.

4.3 The Baker may alter the design if necessary for safety or quality reasons.

4.4 All amendments must be made in writing. No changes can be made within 14 days of the event.

4.5 Exact Pantone colour matches cannot be guaranteed due to variations in edible materials.

5. Allergies

5.1 All cakes are made in a kitchen handling allergens including wheat, dairy, and nuts. Trace-free cakes cannot be guaranteed.

5.2 The Client must inform consumers of allergen risks.

5.3 The Client must notify the Baker of any dietary requirements before booking.

6. Non-Edible Items & Fresh Flowers

6.1 Cakes may contain non-edible supports such as dowels, wires, flower picks, or ribbons. These will be listed on the delivery note and must be removed before serving.

6.2 The Baker is not responsible for misuse of non-edible items after delivery.

6.3 Fresh Flowers:

  • Must be supplied by the Client or florist.

  • Must be suitable and non-toxic.

  • The Baker is not liable for contamination caused by unsuitable fresh flowers.

7. Delivery

7.1 All cakes are to be delivered.

7.2 The Baker is not liable for damage after delivery.

7.3 A delivery note must be signed confirming the cake arrived in perfect condition.

7.4 Cakes must be handled, stored, and displayed with care.

7.5 The venue must provide a safe, stable display table and optimal room temperature of 23 degrees Celsius or below.

7.6 Delivery charges vary by location and may change if the venue changes.

7.7 Cakes displayed outdoors or in heat are at risk of melting; responsibility passes to the Client once delivered.

7.8 Decorated cakes should never be stored in a fridge, and we take no responsibility for cakes damaged due to cold storage

7.9 Delivery times cannot be guaranteed due to traffic or weather.

8. Collection

8.1 We do not allow collections. all cakes must be delivered.

9. Complaints

9.1 Complaints must be submitted in writing within 48 hours of delivery, with supporting evidence.

9.2 Any design issues must be raised immediately upon delivery/collection.

9.3 Wedding cake sketches must be checked carefully by the Client.

9.4 For complaints regarding quality, 75% of the cake must be returned within 2 days.

9.5 Clients must not post negative information online without notifying the Baker and giving opportunity to resolve the issue.

9.6 Refunds are at the Baker’s discretion.

10. Additional Terms

10.1 The Assignment may be terminated if fees are unpaid or if the Client breaches these Terms.

10.2 The Baker is not liable for force majeure events.

10.3 The Baker does not permit additional cakes from other suppliers to be served unless previously agreed.

10.4 In exceptional circumstances beyond our control, (illness, fire), the Baker may cancel and issue a full refund.

10.5 The Baker may use images of your cake for marketing and promotional purposes.

10.6 Cake quality cannot be guaranteed more than 48 hours after delivery.

Performance of this agreement is contingent upon our ability to complete the Agreement and is subject to labour disputes or strikes, accidents, Acts of God, and other causes beyond our control

11.Gaurentee

11.1 Should you be unhappy with the cake we will do everything we can to rectify the matter before the event (if this is an error on our behalf and in contradiction to the invoice). If we are to blame and you are still unsatisfied, then we will refund the price of cake in return for the product.

11.2 If there is a design problem, the cake is to be photographed and e-mailed within 48 hours of the cake being delivered. Situations where the cake is eaten, and therefore not returned, vouchers may be offered if we deem we are at fault in design.

11.3 If you have a complaint about the taste of the cake then a sample is to be provided within 24 hours. If you are not satisfied with the outcome, Trading standards will be asked to review the case, and we will abide by their decision.

11.4 Delivery, When a cake is to be delivered it remains the responsibility of the company while in transit. Where any damage occurs then it is the sole responsibility of the company to make good any damage. If this is not possible, for whatever reason, then a full refund will be given.

11.5 The Guarantee is immediately void if any of the above Terms and Conditions are breached in full or in part.
